  • Shared Ownership Property repair dispute

    Hi everybody, I live in a shared ownership property run by Magna housing is south England. I recently had some slipped tiles and contacted then via email asking if they could clarify who is responsible for repairs to the roof and made it clear on my email I was a shared ownership, and asked how I could obtain a copy of my agreement as I could not find mine. Magna take weeks to respond so when someone turned to repair the roof tiles I assumed it was theirs. I have now received an email from Magna stating the person allocating works did not realise it was a shared ownership property and work should not have been carried out by them. The workman did not ask any questions regarding property status at the time. I have sent a response to the £141 invoice offering to pay for tiles but question my responsibility for the rest as I clearly stated I was shared ownership and did not request work. I have pasted my original email below and would welcome any advice before engaging any legal rep. Thanks in advance

    Sir/madam,
    I am a shared ownership/tenant at 2, xxxxxxxx xxxxx, Cxxxxxxxx, Dxxxxx and would like to know who is responsible for repairs to the roof of my property. I have some slipped tiles at the front of my house and a crumbling wet ridge at the gable end. I cannot find my lease agreement and would be obliged if you could assist me in how I go about obtaining a copy.

    Tell them you still need the agreement and when you have it pay accordingly
    OR
    If it was your responsibility the cost would seem low for the work.
    OR
    It was fixed at a low figure just pay up. Legal advice would cost you more.

      Obviously you need to understand the agreement.

      But surely if you have a share of the ownership it is reasonable to expect that you have a share of the responsibility for maintenance and repair.

        Sorry, I think I may need to explain further, I didn't ask them to do the repairs, I merely contacted them asking who's responsibility it was, I made it clear I was shared ownership and asked for a copy of the agreement. At no stage did I request repairs.
