  • Neighbour garage dispute

    Hi Everyone..
    I bought my house and it has a garage at the back of the property, right at the end of the garden.
    I could only access it through the land of my neighbour, (he chained the gates so we have right to access but was never allowed through). We recently cut down the trees that were blocking our access from the garden. We found steps under our trees leading to the garage.

    Now... My neighbour has occupied the garage and claims it is shared. The title deeds all indicate the whole garage is mine, and solicitors have confirmed this too.
    We have given many notices to vacate the garage and he hasn't done so. We removed the door today because we are regaining access. He had his things all over the garage but now he has moved them over to what he calls 'his half'.
    I would like to take back my land as he does not pay me rent, nor has he bought any land from me so he is using and occupying for free.

    What do you think I should do next? His things are in there, he has been aggressive and verbally abusive, has caused many problems for me, and talks bad about me to the other neighbours (I've heard them with my own ears). I'm not a drama person and have just been kind about it all but it's not working in my favour. I just want my land back and want to live in peace.

    Without seeing te title and the land it is difficult to visualise the Layout.

    The fundamental rule about neighbour disputes is that the value at stake is usually quite small, and the cost of resolving it at law a big mutlipe of that, and even if you win, all you have is a neighbour who is even more pissed off than he was when you started.

    Talk to him. I expect that that sounds impossible, but it is the only solution.
