  • Guarantor for rental property

    Hoping someone could help me, 10 years ago a became a guarantor for a family member, I’d really like to get out of this agreement as they have disputes over bills and behind on payments. I have my own financial difficulties so obviously I’m very worried about still being part of this agreement. Also although my name is on this agreement I never actually signed it myself and have never had any paperwork for this.

      A family member needed a guarantor to be able to rent a house and I did it, I’d like to get out of this agreement but as far as I can find out I cannot leave this agreement but circumstances have changed and I’d really like a way get get out of it

        For the guarantee to be enforceable it has to be in writing and signed by the guarantor or their authorised agent.
        So if you didn't sign it, did you authorise someone else to sign for you?

          These agreements are rarely enforceable and there is an argument that if a new AST has been signed since the agreement is void. Firstly did you see the AST before you signed? Was it executed as a deed?
