  • Discovered I own part of neighbours drive

    Hi. I bought my house two years ago. It’s a detached bungalow with a narrow driveway at the side belonging to the neighbour. Always thought it was strange the neighbour owned the whole passageway as we have a window overlooking it and guttering sticking out quite far. Looked through the land registry documents online and found a Document our conveyancer missed detailing an agreement between the two houses in 1953. It appears that half of this driveway is indeed next doors. However quarter of the driveway is theirs which we are allowed to use for access to clean our window. The nearest quarter to us is ours and they have an easement over it for access to clean their windows. This space between our houses has been gated by the neighbours for what imagine has been many many years.
    I am keen to reclaim this land if possible. It would in the future prevent any neighbours extending right up to the side of our house. The neighbours have also squeezed their caravan down this alleyway and it’s so tight it is touching our house causing damp. It would be nice if I could ask them to move it away from our house and be able to explain part of it was an our land.
    In addition do I have any recourse with the solicitor we used who missed this document. We did have a free government grant for external insulation and we were unable to do the side of this house As the landlord said ventilation would have extended land. As it turned out this will not be the case!
    Also to add this document was not referred to in our deeds. It was referred to in our neighbours deeds. I then applied to the land registry to get the full document.
    What are my Next steps? Can I just assume that land is still mine. Or do I need to fill in a form or get a solicitor to back up my findings?

      If the easement is not noted in your proprietorship register, yes, ask your conveyancer why not and request s he corrects the record at his cost.

      You are perfectly entitled to ask your neighbour to move his caravan from your land.
      He will not be able to claim a prescriptive right to it as he already has an interest by way of the easement

      Just go softly as he will still be your neighbour
