  • Charging order on house

    Hi iam looking for some guidance and apologise if this had been raised already.

    I am looking to sell my house however upon checking the title register there is a charge registered on my property.
    The charge relates to debt registered against my husband who had passed away.
    The property is in my sole name. In view of the circumstances am I able to apply to remove the charge, is this possible . Thank you.

    Has the house always been in your name or was it in joint names before your husband died? In any event, the debt should have been paid out of any estate (if there was one)
    pt2537 might be able to help if you can answer the above.

      Yeah that should have been dealt with through Probate and the charge removed following repayment out of the Estate. If it was dealt with by a Solicitor, contact them as they would/should have contacted them straight away
