  • Shared freehold with flats and houses, confusion on lease terms/TP1 restrictions

    We have a shared freehold run by a management company with one share per property. The freehold title contains the site's original restrictive covenants and a schedule of leases for new flats that were built on the land. The schedule of leases has one note on each flat stating that the lease grants sole use of a numbered parking space marked in brown on plan. We then also have several houses that have TP1s, with a whole raft of restrictions on the fourth schedule such as no BBQs on common land and no parking anywhere on freehold except in spaces by right of user, etc. Do the restrictions on the TP1s apply to the flats who have nothing mentioned on the schedules? Or are we missing a document, maybe there is an actual lease document I'm not aware of? I've got a copy of my TP1 and my mate in the flat was blissfully unaware and would like to know where to look for his lease terms. Mostly he's taking the mickey as he is going to have BBQ that I cannot attend. Git.
