  • Notice of severance

    Hi all,

Im after some legal advise/reassurance please.

I own a joint residential property with my parents in which I believe we all have an equal share.

My father is doing his Will currently and asked me to sign a notice of severance. Stupidly, in blind faith, I signed this document without reading it as I was in a rush. As things are not the best between me and my parents at the moment I’m wondering if there is a possibly I could have signed away my share of the property via this notice of severance document? Another document followed this document to sign, which I believe to be a land registry document.
im sure it’s not this, but I need to put my mind at ease for being so naive. I’m hoping this document would only permits my father do manage his share of the property and his only. Should he have told me what he plans to do with his share?

    Many thanks in advance

I suspect you owned the property as joint tenants with your parents.
Your father has now taken steps to change the manner of owning the property to one of tenants in common.

As joint tenants when any one tenant dies the other(s) automatically own the dead persons share by right of survivorship
By changing the holding to tenants in common your father can leave his share to whomever he wishes (without telling you)

Only thing to be aware of is the %age each of you own.. has this been set out somewhere?
