  • 500mm eaves overhang 😳😳

    Hi, my property boundary includes a delapidated building owned by next door neighbour. He has renovated the building and taken it up a story. Issue is the eaves overhang is at least 700mm onto my ‘air space’. I have not had any request from the neighbour for this overhang to be agreed by me so I am wondering what my options are.
    any thoughts would be greatly appreciated. Cheers

        It is a trespass, however..........

        If it is not possible for the property to be altered at proportional cost a court might only award you damages without an order to remove the overhang.

        If the overhang is not too much of an inconvenience a chat (if you are on speaking terms with your neighbour) to negotiate an easement with him might be a better option than court.

          Most options are usually better than court in my opinion.
