  • Relocating point of access through neighbors garden

    Hi looking for some answers I'm struggling to find on Google. If anyone can help me or redirect me to some I would be extremely grateful.

    We live in a row of three terrace houses. We are number two with number one on our left and three on he right (looking at the houses from he front) there is access through the back gardens for things like taking the bins out. We go through number threes garden and number one goes through ours and number threes (sorry if I'm making it sound completed)

    Anyway we have new neighbors at number three and they want to put an extension on and say they are going to put the access at the rear of the garden however this would mean us having to take our bins over our grass to get to it. The issue is our garden is built up at the back and not really safe enough for us to do so also our neighbor at number one is registered as blind after having a stroke and we have three kids so the garden is full of children's toys for him to navigate his way around (I do take his bins out but he is old and stubborn and tries to beat me to it)

    Can my neighbor just move the point of access or is there a way I can stop him doing so

    I have attached a drawing of the current access and where he wants to put the new points

    The owner of the land burdened by a right of way has no right to alter its route, unless that right is an express or implied term of the grant of the right.

    So check your deeds to see if they show the route of the right of way
