    hello
    5 years ago i highlighted to my neighbours that their low rooting tree had already damaged the fence between us and that it was now damaging my drive - some 5 years later again i have highlighted this and finally they are agreeing to cut the tree down
    However the landlady's insurance has confirmed that I must claim from my own insurance with regards to fixing the fence and flooring around it on my own property.

    How can this be right and what can I do

    Get their insurance details and pass it on to your insurer - let them sort it out. Of course giving all relevant detail with photographic evidence.

      In order to be able to claim from the neighbour you have to show negligence on their part. As previous poster said, pass it on to your insurers and make the claim for the remedial work from them. If they believe there is a case of negligence they will deal with it, by claiming from the other party, although it is unlikely.
