  • Access to Neighbouring Land Act 1992 - Refusing my neighbour

    Hello Everyone

My neighbour requires access to my land in order to repoint His chimney. Who is responsible for the legal/court costs should I refuse him and he goes down the line of a court order? i am assuming him as I have read the courts can award compensation to the affected neighbour.

To put it into context we had a small extension this year and he caused us no end of issues under the PWA. He remains abusive and threatening towards us even though the extension has had absolute no effect on him whatsoever. Although it is not about the money, the PWA cost us a fair amount due to him not cooperating, so I don’t think it is unreasonable to refuse him access and make him go down the court route.

Such a shame as we used to get on fine.

Many thanks for you time and opinions
