  • Rubbish dumped on property

    Hi, I've recently had rubbish dumped on my property. There was a letter with an address of a neighbour in one of the bags.
    My local council enforcement office came to investigate, and spoke to this neighbour.
    They said they couldn't reveal what was said but said I would be held responsible and have to remove the rubbish in x number of days.
    My question is, can I request details of their investigation, and see what was said? Is there any kind of appeal process?

    Rather than go to the council I would report it to the police, as Fly Tipping is illegal .

    You don't say how much rubbish -- (one bin liner or a skipful)

    At least some (if not all) of the rubbish has come from the neighbour, so he should contribute in part at least to the cost of removal.
    Can he identify the person who collected his rubbish?

      hey, thanks for response.

      i actually did go to the police first, but they weren't much help. all i got was a crime number and a recommendation that i ring the local council who are equipped to deal with these situations.

      theres about a skipful of rubbish i would say.

      in terms of identifying the person who collected his rubbish, i am unable to find out as the enforcement officers wouldn't actually reveal what was said, and if whether this is what he claimed anyway. its basically being committed of a crime without being able to see/hear the evidence against you!

        So a person disposing of rubbish must only do so via a registered waste carrier.
        If that person's rubbish is found illegally tipped they are liable for the cost of clearing it.

        This was not a small amount so I would first be complaining to the police about them not investigating a crime.
        I would then write to the neighbour explaining what his legal responsibilities and liabilities are.
        Also tell him you will be instructing registered waste disposal to clear your ground, and as there is proof the rubbish (or some of it ) emanated from him you will be looking to him for reimbursement, if necessary via the courts.

        Keep photographs of the rubbish, and keep that envelope you found.
        If you find other evidence photo it in situ.
