I am currently mid way through an extension and have run into an issue with one of my neighbours. They have written a letter suggesting that I failed to serve them notice under the Party Wall Act due to excavating within 3 metres of their car port. I served my neighbour on the other side notice due as the extension fell within 3 metres of their building and got a party wall award in place. The now 'problem ' neighbours actual building is over 3 metres from my new extension, hence why I never served them notice. They have a lean to car port which is held up with wooden post uprights around 1ft away from my building line. The port is open along the side next to my building and to the rear. The part facing the road has some doors on it. So my question is - Should I have served them notice under the act? I did not think and still do not believe that a car port of this type would constitute a building under the act? For starts it doesn't have foundations.
