  • Injured due to Property Management Negligance?

    Hello,
    So a couple of days ago, I was using the back gate to access my flat block when the bolts came out of the wall so the gate fell on me. It caught my collarbone which the hospital has confirmed has left me with a trapped nerve and chipped collarbone. I was very lucky that when the gate fell on me, one of my neighbours heard and came to help me. It was then I found out her partner had already complained about the gate needing replacing over a year ago to the property management company but nothing was done. I raised a complaint with the property management company saying the gate needed looking at urgently, as it was now left half attached swinging in a public alleyway. This gate is not small. It's made of metal, as high as a garage block and wide enough to cover the parking space I was trying to access. The property management company are claiming it was never fixed due to there being a dispute who's responsibility it is. The property management company are saying it's the garage owners problem and vice versa. The property company called me yesterday to assure me someone would be out straight away to look at it. Now 24 hours later someone still has not shown. I called environmental health to get a very patronising woman tell me oh dear and that there was nothing they could do for 21 days. This is ridiculous. If that gate falls on someone it could kill them. I was very lucky my 8 month old was in the car, not in a sling like he normally is. Now, it could easily fall on a member of the public or damage someones personal property like the numerous cars parked in the alley way. Where do I stand with this?*
