  • Rented flat - noise from bar till 3am

    Hi,

    Last week my girlfriend and I moved into a flat in a small city centre. It’s a picturesque town/“city” (it has city in it’s actual name) and there are restaurants/pubs/bars in it.

    About 100 yards from our first floor flat there is a bar. On Friday and Saturday the bar ramps up its music until 3am. It’s actually more thumping base than music.

    We knew the bar was there before we moved in but had no idea it would be open until 3am nor that it would play sleep depriving vibrations when we both work on Saturday morning.

    Legally, is there anything we can do? The tenancy is for 6 months until March and I don’t want to risk getting a CCJ for unpaid rent.

    As a former local authority litigation solicitor who dealt with these cases, I suggest that your should keep a written record of the times and dates of the incidents and describe the noise such as, Unable to get to sleep until after 3.00am or and I have to turn my TV up to an excessive level. Then contact you local environmental health department to make a formal complaint. In addition there will be conditions attached to the alcohol licence regarding not causing excess noise and disturbance to neighbours which the licensing officer at the same council can deal with. Your landlord can't do anything and therefore do not withhold your rent.
