    dear all, few years back we have had a new neighbour in the house above our flat. When they arrived they got signed off by the council, then proceeded to change the flooring into laminate like flooring + screening. On top of this, the whole bloody building does not meet fire & building regulations. One of the flats caught fire last year and has not had any work done because of the broken regulation in this housing estate. Housing was built around 1970’s so it’s a bit of a flunk however for example, there is nothing between floorboards between separate dwellings, also there is wooden cladding on the upper 1st and 2nd floors.
    Now I’ve just had the council come over and I’m a bit annoyed so ill put this out here now. I’m Living with diagnosed PTSD and partner has complex mental health. On our own we are classed as vulnerable and we have to live with these disabilities, which is apparently a “lifestyle choice” according to an environmental officer, were get to that later.



    Since they moved in it was fine, then they had a dispute with us about the smell of weed which is coming from everywhere in the neighbourhood, we asked them to stop retaliating to which they have not so now every step is vibrated across our ceiling all hours of the day except maybe 6 hours at night sometimes less as there are other neighbours who will live their life normally but not caused a habitual nuisance every morning, day and night, they come in past 12am every weekend wake us up with constant banging slamming cupboards, shoes across the floor, banging tables and chairs, whilst all their family are on the second floor having an undisturbed sleep we have to deal with this distress.
    We have had noise equipment in, at the time I don’t think it was great evidence however there was persistent banging & slamming all hours of the clock bar a few hours during early hours of the morning to which they don’t find a nuisance, They told her to stop taking the mick as it can be continuously heard, but because they didn’t action anything it has given them reason to do those things worse.




    Now we havent been great ourselves, but when you are woken 6 times between days & nights for the same reasons from the same 4 adults you just want to blast your music a little, especially when I am having a PTSD episode at night to distress with the continuous banging which isn’t a switch you can turn on and off for it to happen again at 8 oclock in the morning continuously every 2-5 minutes. now I’ve always had my music on loud, but since they moved in I would turn the bass on max which was the worst thing to do, didn’t get any order against us about it, but we did get a stern telling off because if it's persistent they will have legal right to take out proceeding against us which we cut out since then and really not the kind of guy to get into any legal trouble as I had been brought up well, however their persistent banging is way louder than the allowed volume and it’s very intrusive meaning we cannot even concentrate whenever they are around. It’s a complete echo chamber throughout our floorboard so even when they overload their washing machine not only do we have to put up with the sound of a constant bang by the washing machine spinning also it echo’s throughout the whole floorboard causing ear ache for both of us.
    I’ve never had an issue with a neighbour, only since when they moved in and changed the floor they have had problems, we could take it when they where friendly but now it’s distressing everyday. I cannot even come home after surgery, I have to stay at my mothers because you cannot simply life your life.
    So you could ask yourselves why don’t we just move? Well we have secured tenancy, lived here for 15 years, have a dog & 2 cats who are settled amongst me and the significant other never had an issue with a neighbour before. The previous tenants had a kid with ADHD, did he bang everywhere, nope just on a couple of weak spots within the flooring you could hear something. That wasn’t an issue, didn’t affect our lives too much.
    So now we just had the council come over telling me that our music is loud but not a nuisance but they’ve called the council up saying we’re being loud when in fact they where constantly banging everything they could think of since 7:40am yet again. The one time we called them it wasn’t “considered a priority” I told the environmental officer that everything before their call I was recording with my phone (which I’ve already sent her) Yes it is going to hear my music clearly, but even my phone and our ceiling fan is vibrated when they’re stomping around.




    So now we at being frequently harassed by someone who’s made changes to their dwelling and weaponised it against us every time they’re not happy.
    Is there anything on the legal side we can use? We have called up the police and made a statement, at the moment they haven’t got grounds but the sarge told me to record every continuous disturbance and come back to them in a few months.
    We’re in England so if anyone could guide us on any example cases around frequent banging caused by changes not by us above disabled people that causes their disability to get worse then that would be great.
