    Hi. Guys. Not used you in years and you helped me back in 2009. I live in council blocks on the 2nd (top floor). I have a leak in the roof and when it rained heavily on Saturday the rain came in. Not to my flat but I heard it on the ceiling. If it rains next week and there is damage. Who do I claim against? My home content insurance or the council. I feel that my home content insurance would be invalid as they could state that the fault was with the council’s roof and they are responsible. The council could argue the same.

    As I understand the position the council, as landlord is responsible for repairing the buildings damage because they are responsible for keeping the structure of your home in repair.
    As the roof is a communal area there is no need for the leak to be reported before the council become liable for any damage that it might cause, including damage to your contents plus any loss or inconvenience you might suffer.

    however I would report the problem asap.

    contents insurance is your fallback position, and it would be for the insurers to pay out and then claim back from the council

      Hi I have gone through your post. Here I want to suggest that If you own a property you’ll need both, but as a council house tenant, the council covers the buildings insurance.Homeowners insurance maycover a roof leak if it is caused by a covered In those cases, your homeowners policy may help pay to repair the roof leak.And the contents insurance is not compulsory if you value your contents and possessions insure them.
