  • Suing council for property devaluation, possible?

    Good afternoon all,

    Just wondering if anyone could possibly assist and provide some advice,

    I live in croydon/ on an estate, we own our house outright the estate has currently undergone some regeneration, recently we received a letter from the council stating they plan to scrap the individual house bin collections and move to a single communal bin stores, which is going to be placed literally opposite our house - 10feet or so from my property, loads of residents have complained about this well we are putting up a bit of a fight.

    However if this unfortunately goes ahead, can I and my neighbours put in a lawsuit to sue the council for devaluing the property, as I highly doubt anyone would even want to buy a house with a communal bin store opposite, not to mention the flies/ smell in summer/ foxes/ rats etc..

    I have had a google and come up with a few results but mainly the lawsuits were to a neighbour not the local council,

    If anyone has any advice would be much appreciated

    first enquiry I would be making is do these stores require planning permission? and then check building regulations especially regarding positioning
    vis a vis neighbouring properties
