    Hi
    we have rented a house with an assured shorthold tenancy since april 2014. our landlord lives next door. its been perfect. rent paid every month. never a problem. then this envelope drops throuth the letter box without our names on even. two pages form 6a. tells us to leave after 2nd july 2019. or he will seek an order undersection 21. so is it an eviction notice ?. if not does he have to serve a section 21 notice. we pay our rent on the 12th of each month. Is it correct wording to tell us to leave after the 2nd. how long after ?. all seams a bit odd but that's life.

    Giving tenants a Section 21 notice


    You must give your tenants the Section 21 notice by filling in form 6a if the tenancy started or was renewed after 30 September 2015.

    Otherwise, you can write your own Section 21 notice. If it’s a periodic tenancy, you must explain that you’re giving notice under Section 21 of the Housing Act 1988. How much notice you need to give


    A Section 21 notice must always give your tenants at least 2 months’ notice to leave your property.

    If it’s a periodic tenancy, you must also let your tenants stay for any additional time covered by their final rent payment.

    This does apply to shorthold assured tenancies. I would guess your landlord is possibly looking at selling the property.

      Hi setmefreez.
      lived next door to landlord for 5 years. nice chap. notice served 2. May. told to leave after 2 july. agents said by second of July. rent paid on 12 each month, I gather this is a periodic tenancy. therefore from what you say we should be allowed to stay until 12 July therefore. is this in stone or goodwill. Id rather it was in stone so to speak.

        If you haven’t found another property to live in yet, you should approach your local council and make them aware of your circumstances. Take all documents you have received to them. Hope this helps. Good luck.

        I would imagine your landlord is going for the original date given to you.

          Hi again,
          Yes of course am looking and indeed have applied for a property. However I think tenants should be treated correctly. all of them. in this instance our tenancy was created in 2014. it has become a periodic tenancy. I read as you have stated the notice should be from the beginning or the end of the payment periods. So in this instance notice was served half way through a rental periodand the period it ends falls in a period we have paid or will have paid for.

          So 1 should we be entitled to remain until the period we have paid for ends. the 12th of the month makes sense and of course seams reasonable. 2 could this make it an invalided section 6a notice. the rules are strict and for good reason. Nothing wrong in challenging them if you have reasonable grounds.
