A local developer with the backing of the local council recently claimed that objectors to his plans were committing trespass by walking their dogs on the land he intended to develop. My query is can trespass be claimed where
1. There is no clearly marked boundary between the land and a public footpath.
2. There is no signage to say the land is private property.
3. Dog walking etc has been going on on that land in excess of 45 years with no challenges, warnings or charges.
