  • Freedom of Information request to County Council

A large (foreign owned) utility company is trying to implement a nationally significant infrastructure project near me. They are sharing critical site selection and design information with my County Council and my District Council, who have told me that they have signed non-disclosure Agreements with said utility company and have so far not responded to requests for the information. I wish to see this information to make sure my representations are properly informed.

Can I raise FOI requests on the Councils, or can they hide behind the NDAs they have signed, even though the information (we are told) will be publicly released in for months time, and is unlikely to be commercially sensitive other than exposing weaknesses in their planning arguments.

    Any advice much appreciated.
