  • Offer on a property through a Power of attorney

    Needing some good advice again if I could... we have a cash offer on our house and today have put in an offer on another , The property we have made an offer in is being negotiated through a niece of the owner of the property as she is in a care home . The niece is power of attorney.

    We are now told by the agent that there was already an offer made by a friend of the family but considerably lower than ours. We are not needing a mortgage for the property and we have a cash buyer with no chain.

    The niece(power of attorney) is considering the offer. I was under the assumption you had a legal obligation to do what is financially right for the person you are representing .

    I just didn't want to get in a situation where every offer we make would be matched and so take us out of the equation , but it seems odd that if they had an offer by the family friend why wasn't it removed from the marketing of the estate agent ?

    The first offer was 30k below asking price and we have come in 15k below asking price and our max is 10k below because the property has been empty for some time and needs complete refurbishment TIA
