    Yes back again... same problem different issue. Just to simplify.. Neighbour applied for planning permission to build 4 new houses only to get it built they have included quite a sizeable chunk of my land which consists of a lane which exits onto a main road. All my land is freehold and belongs to me in its entirety,

    The lane is crucial to the application moving forward as it's the only route of access to the carriageway. I know that anyone can apply for permission on someone else land (would have been nice to be asked first) but here is my question.

    Looking on the government website planning apps should be determined in approx 8 weeks but should take no longer than 26 weeks and 52 weeks to include any appeals. This application was posted on the planning portal March 7th this year so approx 32 weeks with still no determination .

    I've emailed head of planning plus the case officer but never had any replies.

    What can I do more ? This is extremely difficult for us as we hoped to put our house up for sale . If there is outline planning issued then at least we could tell potential buyers that they could make a reasonable amount of money should they wish to sell this land or they would also be able to put an end to the current planning application as without the lane it could never be built ..obviously if it is refused then all well and good .

    It's the not knowing rendering us in situ until something has been decided

    If part of the land is yours, how can they build without your permission?

      As it is not your application you have no grounds for complaint.
      The most you can do is comment on the application within the time limit and wait.
      Even if you disagree with the outcome of the application you cannot appeal it (I think you mentioned that on your other thread).
      Your only option is to go for a judicial review.

      However as you are fully aware they cannot build on, or use your land for access.
      It is just a pain tn the neck as you want to sell and this is going to affect your marketing.

        Thanks.. I know there is nothing I can do as such and also nothing they can do I just thought as it's affecting me with it being my land there would be allowed to comment and ask when it will be determined now it has passed the recommended time limit Government have to keep planning moving
