  • Boundary Fence

    A couple of years ago my neighbours asked us if we would contribute to the cost of them putting in a new fence in between us.

    At the time we said no because their dog would jump up and damage the fence like it had done the old fence.

    The fence was placed on our boundary, without asking permission, but we did give the neighbour permission to put the fence into our corner post.

    Last year, the neighbour sold up and moved, and an oldish lady living on her own moved in.

    This lady also has 2 dogs.

    The Westie has started jumping at the fence, barking at our cat, and we are concerned if it damages the panels.

    We also want to put paint on the fence to protect it, as it was never treated.

    As the fence is on our boundary, can we claim ownership of the fence as the original neighbour has now moved away?

    Where do we stand if the dog next door damages the fence?

    Probably worth popping next door and having a chat with her about your concerns over the fence needing treating, and maybe she would consider putting some planting on her side so her westie doesn't spend quite so much time leaping up at it Really just let her know you're going to treat it/paint it and go from there.

      It is not your fence, so if you want to paint it ask the old lady nicely.
      You say "your boundary", but a boundary is only the line on the land where adjoining properties meet.
      If your deeds or registration details put the onus on you to maintain the fence on that boundary line it is for you then to so do.

      Regarding the dog, owners are responsible for damage caused by said animal.
      If the existing fence is damaged, as it is not yours there is nothing to be done .
      If you replace the fence at your own cost and that becomes damaged by dog you could ask for a contribution towards its repair.
