I wonder if anyone can help me. I rented out my house back in November 2016 for a period of 12 months under an AST. Since November 2017 it is a statutory periodic tenancy as I am led to believe. There was a new installation of a boiler and the gas cert was issued. I have not got a valid EPC certificate or renewed the gas certificate as my mother passed away recently and totally forgot.
The tenant is causing misery for the neighbours so I want to issue a Section 21a and give them notice. Can I get access to the property (under the agreement of the tenancy agreement) and get the new gas cert and an EPC cert done BEFORE I serve the notice?
Will the section 21 be void as the EPC was not done at the initial tenancy stage or will it be valid if at the time of serving, there was a valid gas and EPC cert? If it isn't valid, how on earth do I serve a notice to the tenant?
Any advice would be appreciated.
PS There was no deposit taken so the deposit is not in protection.
