Back in 2006, my neighbour built a 3m extension across the boundary of our terraced houses. During the building works, unknown to me, the rain water drainage from the extension was connected to my rain water drain at the edge of my property by running a pipe along my garden under the surface. In 2016, I decided to build a 4m extension and my neighbour tried every possible way to sabotage the works going ahead from disapproving the planning permission application to opting to use party wall surveyors. After nearly a year, I finally had the planning permission and party wall award drawn up to go ahead. In 2017, the extension was built. During the works, my original rain water drainage had to be demolished which also included terminating the pipe leading to it from the neighbours property. The neighbour was informed. On completion of my building work, the private building inspectors I used have requested confirmation my neighbour has put in a soak away or appropriate rain water drainage. If left unresolved, the rain water from the neighbour’s property could find its way under my property and cause damage over time.
I have spoken to my neighbour and followed up in writing. My neighbour will not provide any confirmation saying I just need to take his word for it and he also says his builders will not take any pictures of the solution as that is not the way they operate. He said the work would be completed by the 4th Feb but to date I have not had any confirmation from him despite a further letter requesting evidence of the solution.
I need to be assured his rain water is being properly drained and also without this confirmation, I cannot get my building works certified.
What is the best way forward with my neighbour as he has shown he is unwilling to provide any evidence? He has agreed his drainage pipe should never have been placed on my land and he will resolve the drainage issue.
