  • Being added to a counterclaim as second part 20 defendant.

    Hello,

    On behalf of my own Ltd company I pursued two unpaid invoices via MCOL from two other Ltd. companies controlled by the same pair of directors/shareholders.

    Claim A resulted in a default judgement (I'm guessing they decided to ignore this claim as they as trying to have the company struck off - companies house have agreed to postpone the striking off).

    Claim B they have filed a defence and counterclaim. As part of the counterclaim they have added me, personally as 'controlling mind' to their defense and counterclaim paperwork as a 'second part 20 defendant . The only way I knew this is because of their paperwork that was attached to the courts request for the allocation questionnaire. From reading around it appears to me that I should have received some sort of paperwork from the courts for me to acknowledge service or to be able to file my own defense against their claim separate from my Ltd companies defense.

    In short, they appear to have simply added my name to their counterclaim statement of truth and not followed any kind of procedure. Is this proper? If it is proper, how would I, as 'me' rather than as my Ltd company file my own defence/acknowledgment of claim?

    If anyone could give me some guidance on this I would be hugely thankful.
