  • Can I ask other builder do his building work?

    The builder didn’t do work correctly and now we are facing water problem and worry water will damage the house further. I brought him to the court. I just submitted the direction questionnaires and I am waiting for next step from court. Can I ask other builder to do the replacement work while I am waiting for CCJ? Should I inform court? I took photos and videos. Thank you.

    The court will have expected you to arrange emergency work to prevent further damage.
    Obtaining a price and having emergency work done and to make good and complete the original contractor's work should be part of your claim.
    Provided you stick to the same scheme and don't make significant changes

      The builder didn’t connect ACO channel to the drain. If ACO is lowered and connected to the drain, the patio needs to be lowered too. Emergency repair is impossible, need to redo the whole work. It also caused my neighbour problem. N180 direction questionnaires was sent to court. Will I be punished if I ask other builder to do the replacement work in the middle point of the case?

        No, but you need to make sure that you have all the evidence that you need to prove your case against the defendant builder.

          Out of interest what did you base your claim on? Did you pay the builder for work he had done?
          Is your neighbour's property being damaged by flooding caused by incorrect installation of the drainage channel?
