  • Illegal Eviction, Harrassment and the Police

Back in march my new landlord tried, unsuccessfully, to lock me out of my flat, following verbal threats from both him and his wife, over a late rent payment. I was going to follow it up, but once the money was paid, he apologised and we called a truce. I didn't think he would try anything like it again after I'd explained to him how illegal it was.

I lost my job, and have been claiming job seekers allowance. I put in a claim for housing benefit, but the landlord refused to give me the details required.

Today, his wife wanders into my flat showing 2 girls around, and I ask her to leave as she has no right to walk in unnanounced. She yells at me a bit and says the landlord will 'come and sort [me] out'.

In a state of panic (I suffer from anxiety attacks) I grabbed a kitchen knife as two large black men (my landlord and his friend) charge in and start threatening me. His friend pushed past me and blocked me in the hallway, refusing me access to the rest of my flat and continue to threaten me, saying that they will physically remove me if I don't leave and that my stuff will be thrown out onto the streets. Since they made no move to actually hurt me, and were trying to provoke me, I threw the knife away into the hallway and called the police.

The police did arrive quite swiftly, and while I went to meet them downstairs my landlord took my keys from the flat, which I was not aware of until later.

The police were most unhelpful and somewhat rude.
I tried to explain that what the landlord was doing was illegal and they told me that he was in the right, that they knew nothing about tenanacy law, refused to find out anything when I asked them to, and said that if I didn't leave they'd arrest me for holding a knife - in those words.
They basically said it was ok for him to lock me out and throw my things out onto the street.

While I was collecting my shoes and bag, that were by my computer, I tried to bring up a webpage explaining how the situation was illegal and the police officer told me to stop wasting time, that he wasn't interested and anything I showed him wouldn't change his mind.
I called a friend and asked him to speak to the police, but they refused to listen and refused to give a badge number.

Completely shaken up by this point, I left the flat with the police. At this point I discovered the landlord had abducted my keys, and I had to protest to get my keyrings and other non-flat keys from him.

The landlord also called the rspca to try having my pets taken away (I hobby breed mice and hamsters and have several other pets - all completely healthy and well looked after). Fortunately they needed to know exactly how much of everything was there and I had to speak to them. When I told them that they just needed to be moved (I'd rather they be safe at a friends house than at risk from my LL) rather than rehomed, they said they wouldn't take them.

I ended up sat in the street crying, shaking, and wretching and the police told me to get up and leave.

I managed to get in contact with tenancy relations and thankfully they are helping with the issue. I have an appointment with them tomorrow and the landlord has agreed with them to leave the flat as it is for now, but has refused me access.

I just wanted to share this disgrace with the forum, and I'll let you know how it all turns out. I just hope my animals are doing ok.

Good luck tomorrow Doompixie, it sounds like you had a really frightening time. I think if I were you I would get out and start afresh somewhere new.

WTF.................................am sorry Doompixie that you are in such a sh!tty position hun.......The coppers will be easy to trace as the call wll be logged and the switch WILL know who attended the dispute so get their numbers and bloody shout from the rooftops. They are not fit to wear the uniform and shame on them for their behaviour. Your landlord is an ass and should be prosecuted for his behaviour so hang on in there hunny and fight your corner. Keep us posted honey and let us know you are ok.

Re: Illegal Eviction, Harrassment and the Police

I now have a wonderful solicitor on the case and we are pushing for court today to get me back into the flat - I don't really have much choice at this point having nowhere to keep my things or pets at such short notice.

The landlord has claimed that I voluntarily gave him my keys and left willingly, when he actually took the keys out of my flat whilst I was talking to the police - I had to argue to get my parents keys and keyrings back from him.
We seem to have a pretty strong case, so I will let you know what happens later.

We will also be taking further action once the immediate problem of access to the flat is solved.

Forgot to add, a couple of my friends were allowed access in to the flat last night to feed my pets, remove my rabbits and pick up some spare clothes/essentials.
So, thankfully they should all be ok. My rabbits don't get along, so Bunni is back with a friend who recently looked after her and I couldn't be happier to have my little bunny Stew back with me. He'll be leaving my side as little as possible from now on.

We got into court and an order was given to allow me access to my flat. The notice should have been served last night, I am just waiting for confirmation from my solicitor

I now have to go down to the flat shortly and tell the rspca that my landlord is a douchebag, as aparently he has called them to pick up my pets again. No doubt this will be added to the harrassment report.

Re: Illegal Eviction, Harrassment and the Police

well, the LL refused to comply with the order until some time yesterday afternoon. I now have keys, but the LL is continuing to make life difficult for everyone, including his solicitor, I would think.
I called the rspca to explain the situation and they did inspect my house which I am not happy about, but left the decision to take them in my hands as they are healthy and cared for. For all of this I lost 3 newborn mice, which were most likely eaten by a parent through lack of nutrition while I was locked out of the flat. I also had to spend several hours last night catching my 3 rats - one had escaped prior to me being locked out, and left to their own devices the others had further mangled the cage.

I still do not feel safe being at the flat, I can't go there alone and can't bring myself to sleep there. My dad has also made me agree never to go there alone and we are trying to find somewhere else asap.
Does anyone know if the council will help with this or not as I now have keys?
I live in a well known 'rough' area of the city and whilst this is so far the only problem I've encountered, I'm aware that the LL knows a lot of people there, which from earlier events have proven not to have issue with breaking into peoples homes and threatening them with physical violence.

Hi Hunny - I know you have had a really rough time of it over the last few months due to this arse. Have you moved your pets all out to your friends now?

I hope you find somewhere else to live really soon, with a nice landlord. Just look after yourself.
