Hi all......hoping you can help....
I appealed a Possession Order and made an application under s.214 of the Housing Act within the Appellant's Notice. I was successful in the Appeal, but the Judge overlooked the application and so it was not dealt with.
The Judge is now saying that I must make an application and pay a fee.....he says that I would have had to pay an additional fee for the application at time of lodging the Appellant's Notice and that it is in some way relevant that the application was only made at time of appeal?.....confused?
As I understand it, applications made within an Appellant's Notice do not attract a fee in addition to the fee for the notice itself?.....I also made an application within the Appellant's Notice for a stay of execution.....I paid no additional fee, yet this was dealt with and granted?
Any assistance would be very much appreciated!
