Hello good fellows,

I have contacted the court service today who have informed me that the other side has failed to serve a defence which was due on Wednesday.

The other side has now failed to respond to a letter before action and the court claim.

What is next best move?

You can file for default judgment. Did you use Moneyclaim online to file the claim ? If so I believe you can request judgment through there.

Are you 100% you used the correct address / company name etc ?

Yes, I am 100% sure. I have just double-checked it.

I issued the claim through the post to the County Court Money Claims Centre. At the bottom of the notice of issue there is a section whereby I can apply for a judgement I think?

Yes there is, as you filed on paper you should request judgment on paper too.

Once you have done that the Claimant MAY apply to set aside the judgment, otherwise you will be able to go to enforcement in approx 14 days after you get the judgment order.

You mean the Defendant may apply to set aside the judgement?

Does a judgement need to be entered at a hearing with me present?

No, its just a rubber stamping exercise. It just means they haven't responded to the claim so you get judgment by default - it doesn't mean a judge has looked at the papers or anything xxx

Thanks. I'm just hoping they don't suddenly start contending that they didn't receive the claim e.g. it got lost in the post.

I understand a default judgement has now been entered against the other side.
