Private hearing

Dear good people,

Please could someone offer an indication as to how one applies for a private hearing as per CPR Rule 39.2(3). I have seen a sample directions questionnaire/form but see no method of making an application in this respect.

From the above 1.4 it would seem you need to make representations (in writing when submitting DQ?) to the judge conducting the trial.

CPR doesn't contain specific rules. Unless judge says application is not necessary, then apply under CPR 23 procedure.

The application notice is defined, in CPR 23.1 as "a document in which the applicant states his intention to seek a court order".
The general rule is that an applicant must file an application notice. It is worth noting, though, that the rules provide for an applicant to make an application without filing an application notice if this is permitted by a rule or practice direction, or if the court dispenses with the requirement (see CPR 23.3).

The application notice must state:

• What order the applicant is seeking (including interest and costs, where applicable).
  
• Brief reasons why the applicant is seeking the order.
