  • Small Claims - Multiple Contrventions

    Hi good ladies and gentlemen,

    I was wondering that because a small claims track has a limit set of £10,000 in terms of money claimed, what would stop a Claimant from bringing various claims that relate to the same fundamental issues in a series of claims or cases?

    In other words, what if a Claimant submitted a claim of direct discrimination to the court then a few days later submitted a further claim of indirect discrimination against the same Defendant?

    Well, it's potentially an abuse of process. Something similar recently happened to a PI law firm (different scenario, but principle applies), and they were forced to pay the higher fees.

          I think this relates to claims in the hundreds of thousands and not claims (or a series of claims) in the region of 5k or more?

            The fallout was that claims should not be issued in a scatter gun approach where they could quite easily have been issued as one, where the reason for doing so is to avoid paying a higher fee.

            Your argument is having to deal with 2x, 3x or however many times more paperwork, hearings etc, when you should really only be expected to deal with one, certainly where those claims ought to be as one.

              I see. I am not concerned by court fees - I am exempt. What concerns me is the costs associated with tracks other than the small claims track and that a Judge can suddenly switch tracks.

              I am not sure of the way forward in my case. I have potential claims for human rights issues, data protection issues and discrimination issues. I am a litigant in person (with a mental health disability) and, as you can imagine, these claims fast become extremely complex and costly.
