  • Being kicked out because of HS2

    Hello,

    I rent a unit on a farm from a retired farmer; however the farmhouse is on the path of the HS2 and will be demolished some time in the future.
    Initially I was told that it would be a number of years before HS2 would start to purchase property but because the farmer can no longer sell his farm he has asked HS2 to purchase the farm from him, they have agreed to this but won't purchase until all units are vacant (14 units in total).
    We have been given till 31st December 2015 to vacate the units.
    Everyone is happy to carry on paying rent to HS2 and in fact HS2 has already purchased a property next to the farm and has rented it out to a family.
    All the units bar one are used for storage/workshop purposes.

    Hope someone can give me some advice.

    Forgot to say, the block of units that I'm in are not going to be demolished under current plans.

      Could you try to agree with HS2 that you will take up a new rental contract with them (perhaps all the tenants get together if you all feel the same and make a proposition) when their purchase is complete?

      Just off the top of my head, I would imagine that HS2 are not keen to take on established tenancies and would prefer to set their own terms. Agricultural tenancies are different in some ways (they tend to be more secure, hence alarming for some LLs) - they might only require you to vacate for one day. x

        Agricultural tenancies are a specific area of law, and certain tenancies do not enjoy security of tenure under them.

          "A unit on a farm" wouldn't necessarily be an Agricultural Tenancy though, would it?

              I don't understand. OP rents from owner, why would it be an agricultural tenancy rather than a standard commercial one?
