I am at a cross roads with this and need a second opinion please.
I purchased a conservatory to be supplied & Erected and agreed, at an additional labour cost, for the company to tile the floor. At their request I supplied all the materials except floor levelling compound, that was late 2011.
In 2014 some tiles came loose, the company came back to relay them and broke 3. Unable to match them they returned some months later and fitted 3 tiles of a different colour, size & thickness. I have told them that the replacements are not acceptable but they will do nothing more.
I have written to them saying that they damaged the tiles and therefore they should rectify the situation or I require damages, enough to replace all the tiles (£500-£700 +materials) or we will accept a laminate floor laid over the tiles at a cost of £450, even offering to contribute £100 to this in order to resolve the matter.
They are overdue a reply to my offer letter. Can I take this to County Court claiming damages under The Supply & Services act 2008? and if so what would be my chances of winning?
