Don't have to be Turbs.

Their case is that the OP breached an agreement to enter his home, only it wasn't his home, they should have made the agreement with the home owner the action must fail.

It is why they usually so insistant that the home owner be present when they call. They need their signature on the agreement otherwise it is so much toilet paper.

My aunt was in the home but was in a separate room and hard of hearing when the contract was formed she did not take part when the fitters came without id and scruffily dressed she refused to let them in a solicitor said the contract wasn't breached because the windows were not fitted

No contract was formed, the contract to fit the windows would have had to have been made between the home owner and the dealer, it was not. They cannot sue you for someone else not allowing the traders into their premises.

Your defense is

The claimants states that there was a breach of contract between xx and them, in that access was denied under section xx of the agreement.

No such agreement was entered into by the home owner so there can be no such contractual breach

Yes I would. Aggressive sales technique, only way to get rid of them was by signing something, verbally misinformed about cancellation period, on discussion with householder she decided not to continue. Householder vulnerable and in poor health.

They were aware that the signature did not come from the owner of the property. That sort of thing. Subsequent contact intimidatory and unwilling to accept that you did not want the product.

All helps, the main thing is that there POC pretty much ties the to the manner of the breach. So respond to that first.
