I was evicted by a housing ass last march.
i
had lived in my birth community for the past 12 years on the same road. In 2010 winter my prehistoric heating system stopped working and in the big freeze we were left homeless but still paying rent for 2mths and the plumber eventually after weeks of waiting for parts got the heating working , we thankfully didn't stay in the house as my son is type 1 diabetic and the house was like a nice block. I left the house to warm over night, only when I came to the house the next evening it was burnt out . I had no insurance and lost nearly everything we owned! Was given no help from housing as and was left homeless still paying rent for a further 6 weeks until Callander news filmed me and they gave me a house on the same street .
Their ASB department went on a campaign to brand me as an asbo and made up stories (like they are allowed) and lied to police in a bid to get harrassment order served on me. Only months after taking new house.
they even took me to court to get keys for burnt out house and was told to help me clear it as they were refusing. They bullied me and treated me like scum after the fire.

I understand that in a civil court it's whoever tells the best story wins . As it's only hearsay evidence in a civil court.


however these horrible people went to far with their hate campaign and have actually quoted i " seriously assaulted an oap I lived next door to in my previous tenancy" this is where the perjury has happened (I think)


the the asb worker even recorded herself telephoning me and states she has received this information from police intelligence and has full access to my criminal records! Even though I have been asking for 3years for information proving their claims in the initial repossession order. They refused to change this information about me seriously assaulting the oap before the eviction trial. They apparently checked it was truthful numerous times in The lead up to the court case. Although I have emails from the local police officer confirming this to be a lie ! He even states in the 12 years I lived in the community I assaulted nobody. I myself know I didn't assault the oap and know no records exist or are held by the housing ass. I have been requesting they send me copies of the shared info from police or even the crb check they claim to have done on me. But alas I'm being ignored , so feel taking them to court is my only action.

as unable to go to the eviction trial as my disability is worsened with stress and I was bed bound, so they went ahead without me.i was advised until they went to court and swore their evidence no perjury has been committed. I tried to email the judge to inform them. Of perjury but was refused, the police can't do anything as they have no power even though perjury is a criminal offence.

i know the mp Jeffrey archer was sent to prison for perjury 8 years after he committed perjury, but I can't find out how he was brought to justice nor how I can get justice for my family and I


any help would be much appriciated

Is this housing association for real? Perjury is perjury and is the making of a false statement, under oath, before a court of law. The other thing that comes to mind is that there is an offence called Perverting the Course of Justice and, also, Conspiracy to Pervert the Course of Justice. However, in order for it to be Conspiracy, more than one person has to be involved.

I feel that you need to speak to your MP about this and they need to speak to the Crown Prosecution Service (CPS) and the police about what has happened. It sounds to me that your local police force is being very supportive and helpful.

I am somewhat concerned that the housing association has subjected you and your son to the treatment they have, knowing your son has Type 1 Diabetes.

Does what you and your son have been subjected to appear to be related to disability, ethnicity or marital status? It is a criminal offence to discriminate against a person for these a a number of other matters.

Is the harassment still ongoing? If it is, you may need to seek an injunction under the Protection from Harassment Act 1998.

Is this housing association for real? They are the old council workers who were given 100s of millions of government money and turn into Housing ass .they were dodgey and bullies before this,,,now they are monsters !


Perjury is perjury and is the making of a false statement, under oath, before a court of law. Especially when they quote your criminal record and "serious assault" isn't even a charge although the judge didn't spot that as there was a suitcase full of paperwork.


The other thing that comes to mind is that there is an offence called Perverting the Course of Justice and, also, Conspiracy to Pervert the Course of Justice. Conspiracy could be proven as the asb worker is the one who taped herself calling me without my knowledge and submitted this recording to court so its genuine. She claims to have sourced the information on serious assault from police but no evidence was given in the full disclosure the court ordered them to do ! And they ignore my request to forward proof of received info from police! This info was then supplied to her asb manager who then proceeded to write my court possession paperwork where the lies were put, so I believe the 2 women are guilty of conspiracy ..as it was not a mistake it was a fabrication of lies !

My local police officer is very good he was very supportive however after court case I rang police and reported perjury and they said nothing can be done but I should inform the boss of housing ass..which I have done and he's ignored me for 1 year so few mot hs ago I emailed board of directors who didn't reply but investigated the serious allegations I had made by asking asb manager if she lied she told him she never swore evidence in court but it's her signature on the possession paperwork.

My partner was also going through chemo with stomach cancer at the lead up to proceedings being taken.they lied about him too saying he scaled a 6 ft fence only weeks after having 85% of his stomach removed

. I have been disabled 20 years , and they claimed my garden was a mess and my dogs barked, although no enviromental health involvement , other than to say my kennels were fine and the. 1 reported noise nudie nice was never followed up so was being closed.

t definitely I have M.E so they know I could fight my way out of a paper bag.

they served me with HARASSMENT injunction cos same lying asb worker called police after driving 8 miles down the road and abusing my head for 15 mins on the roadside outside my burnt out house I was removing gravel from she said I had threatened her with a shovel. But then months after this event she added to court statements saying a mot h prior to her calling police on me . I actually threatened to bury her in a trench I was digging at , on the day I fetched my partner back from having his stomach operation...she knew she had broken the equality act on this day so covered it up with more lies ! .

i am finally housed in a nice house with a nice private landlord and lovely neighbours,,I have started to recover from the eviction last march and now it's my turn to hang them all with the rope I let them have or should that be the government empowered them to have !

I managed to get the first court trial date adjourned for medical reports. I say I because my solicitors said I had no chance and would be evicted that day. Then the solicitors sent questions to the so called medical expert without conferring with me and basically they thought I was trying to excuse my actions because I had M.E when I fact I was disputing nearly everything they said I had done, and I asked for the report to be done because I needed to confirm I had M.E not excuse things I was being accused of..so when I challenged solicitors about the report after reading it, they came back with we can't represent you any further as I had lost faith in them and proceeded to dump me 2 months before trial...

ou can imagine I was devastated I attended an appointment with a judge to ask for more time to prepare my case or find another solicitor I was refused,,so in the end the morning of the trial I was unable to move and was bed bound and had been for some time before that day due to all the stress!

So they won eviction on automatic judgement cos I was too ill to attend..

So I feel not only have the housing ass abuse there powers in the legal system but also have not had any justice or opputunity to fight my case.

obviously I can't change the eviction but I would like to sue for slander and all the suffering my son and partner has suffered , he thankfully is still fighting his cancer and with only a 20% survival rate I think he's fighting pretty well

This needs to be referred to the Legal Ombudsman. However, I would recommend you speak to them on the phone first as time-limits apply to complaints against solicitors and the LO should be able to advise whether they can accept the complaint for investigation. If they feel there are grounds for reporting any solicitors to the Solicitors Regulation Authority (SRA) they can do so.

Although there is a Housing Ombudsman, it may be something the Crown Prosecution Service (CPS) and police need to deal with. If a solicitor acting for the housing association mislead the court, that is very serious as they could be struck-off as well as prosecuted. This is why your MP might be the best course to pursue

Slander is a spoken untruth and very difficult to litigate successfully without a lot of evidence. Unless the behaviour of the housing association is still ongoing and/or they are still circulating untruths about you, I feel your most practical course of action is to ask your MP to assist. Also, have you considered approaching a support organisation that helps those affected by ME? They can sometimes be very good sources of advice and assistance in such matter.

I have Fibromyalgia which has Chronic Fatigue as one of its symptoms. It can also occur in combination with ME.

It was not the solicitor who sourced the information or rather lied about me as no information of this kind exists.

The police officer emailed me and said there's 2 ways a housing ass can find out criminal records or info

1. Under the sharing agreement and this has to be well documented ,,I have asked for a copy of any police sharing info ,,not even acknowledged as a request

2 housing ass have access. To the PNC computer checks and nothing was current about me at time police officer checked. He confirms by email in the 12 years I lived on the street I had not assaulted anyone.

Even before the court case I asked the asb manager to check these facts as they were. Wrong I received a letter telling me these facts were correct and have been checked multiple times before court! This is where I think conspiracy can be proven, as it have a asb worker claiming to have been giving this info first hand from the police and a manager claiming to have checked all info sourced. So how is it the local police guy was never asked or. The alleged victim who lived next door. In fact the same woman was named as person b in witness statements wrote by the asb department, but no mention of any assault,,it's laughable really...but I can't as I lost my home because of this serious a use of eviction power a housing ass have been given. How can you fight a multi million pound company that have legal departments and laws to abuse to tick the boxes and evict you.

The judge wouldn't have believed me if I had gone to court and said they were liars! They are the professionals who know they can get away with lying in a legal court,,They are trained to do this...I read it's expected to lie in civil court as it's only hearsay evidence and whoever has best story wins,,,,how is this a justice system ?

However because use these people had to lie about me to tick the boxes needed for court I believe I can prove they are liars as they went to far in quoting my criminal record as it doesn't exist not even the charge of serious assault.

One of the first things in my trial pack was I seriously assaulted an old woman, I think any judge reading that would not care what dribble he read after and would have evicted me on that alone ! And surely if I can prove they lied to the courts and claim more lies their integrity has to be investigated or else they are just being allowed to take the mickey out of the legal system..

i get mental confusion and exhaustion and find it hard most days to communicate let alone fight my corner and they know this,, why else after a house fire would any landlord try to evict a tenant months after they rehoused me on the same street. Yet went on to claim I terrorised the neighbourhood for 10 years...I wanted to be housed in the town close to college after the fire,,as my son was in college there but they refused me any decent houses and offered me the worst of the worst,,so calander news filmed me in my burnt out house and approached the boss and that very morning I was offered a house up the road which I wasn't even Aware was empty in the 6 weeks we were homeless and fighting them for housing. Still paying rent... Then my bf came to stay whilst having chemo..they even named him in the court proceedings, the woman is even on the recording telling me I have to send him home to have his chemo alone. He lived in the town 8miles away..she even says his family can look after him,,his dad died of cancer years ago and has no other family, this disgust me...if you send me your email I will forward you a copy of recording it's horrible.

Same woman wrote on my file after I let her in my home,,he's got leukaemia but doesn't look ill...my blood boiled when I read this ..she comments on how I don't pay rent the government do, even laughs at me when I said since ground work has been done at the house by them I can't get my mobility scooter out house..

They have broken the equality laws so many times with me

but equality laws to prove in court are very difficult...

when i I called the ass the other day,,they said I was evicted for rent arrears and un tidy gardens..not lies about assault...

strange that as how can a disabled person be evicted for not been able to keep a garden tidy and if the government pay my rent how do I have arrears especially as I paid rent on a house during the "big freeze" that wasn't liveable 2mths before and 6weeks after the fire that happened once the prehistoric boiler was fixed..yet 8 years previous to this government gave them 100s millions to update council housing but I still had a back boiler system older than me and I'm 40 years old soon ! Major failings in housing where I live

is there any wonder they wanted rid of me !

But out I believe in karma and hope everyone involved in my case that stuck the boot in instead of helping gets what they deserve !

Only thing that is keeping me sane (ish) that and the hope I win the lottery just got to buy a ticket !

What really gets me is the housing ass aren't bothered in the slightest . Didn't even care when my house burnt out, if my son had been younger he could have quite easily been killed as the plumber left late afternoon and it apparently slowly set on fire in the airing cupboard in my sons room, had I put him to bed and not realised the smoke would have killed him.

And all all I get is well it wasn't proven to be our plumber...

and all I can reply is the police investigated and it was also not proven it was me ( which it wasn't)

They don't seem interested in the fact there workers are being accused of lying to the courts, they won't even call the police man who knows I haven't committed an assault I even gave them his mobile number lol . Probably because they know if they do they will have to take action against workers. Does that mean I can take action against the boss and chairman of board because they have ignored my claims ?

So the police told me to inform the boss so he can investigate,,,so does that mean now I approach the mp and cps and ask for investigations into it..?

I quickly googled complaining about solicitors it says I have 6 years I think.

Having read your latest post, I am of the opinion that your MP is the best person to help you deal with this. The only agencies who have access to the Police National Computer (PNC) are the police, other law enforcement agencies and the security services. A housing association does not and would not be permitted to have access to the PNC. Access is strictly controlled. If they are accessing the PNC, then it is due to a corrupt police officer or civilian support staff. If this is the case, then it is very serious indeed. I am speaking as a retired policeman.
