Yip I agree, this has taken up 6 years of your life and caused untold stress alongside everything else you have had to deal with, and you did nothing wrong.

I'm really sorry have to come to that conclusion, and we will try and help as I said. Do you want to have a think about it and then we'll help you with a letter to PHS to try and bring this to a conclusion least painful and stressful on you and your family.

Just wondering whether Pauline couldn't chase the people who actually owed this money (owners of the business who bought the goods) through the small claims court?

If it was a simple partnership and not an LLP they would be jointly and severally liable as individuals.

I know it's added stress to take them to court but it's so unbelievably unjust - this whole scenario - there surely must be some redress?

The other person one might be tempted to counter sue would be the company whose employee tagged t/as onto the OP's signature after the event - that just doesn't seem right at all. :confused2:

Just something that has niggled at me for a while now regarding the registry trust search, phoned them, they couldnt help and told me to phone Neath, Port & Talbot court, which I did and they couldn't explain it Either???

When I have searched the register for this claim nothing has ever come up - with my name & Home Address, or my name and works address, but then i found the claim 8nt00112, Which is the claim against me , but on the register is against T/A Tumble Jungle allenbridge group plc (see attached file-allenbridge reg trust)- Can any shed any light on this?

and when I searched my boss, I ho, this allenbridge group is there again( see attached epleipm)

Re: Can any one tell me what this means?

It's extremely puzzling because Allenbridge Group PLC is a massive investment company. Do you know why it's involved? Was Tumble Jungle anything to do with it?

No not at all - when I first started there mail came for tumble jungle / FairPlay or / temples secretaries ?
but with tumble jungle in the address as welll and the search on my boss Mr? ????? Also has Allen bridge group in the details as well.
sorry, I know I am grasping at straws, it's just so hard to give in to. I have wrote a letter complaining to PHS head office this morning , most likely get put in the bin, but there no harm in trying - I hope.

Got an email back from court today - bit sus to me this ,aloe bridge group what not , nobody can tell me why

With reference to the above case and your email dated 11th March 2014, this judgment has been registered with the title Pauline Carney t/a Tumble Jungle as this is how the claim was issued by the Claimant PHS Group Plc on the 22nd January 2008.

Re: Can any one tell me what this means?

                        Hmmmm.

Obviously you have to take Amethyst's advice and make some arrangement to pay them (it's a ccj and she knows what she's talking about) - the important thing in the short term is to deflect the wolf from the door.

At the same time make it very clear that it's a case of mistaken identity, that you are not and never have been t/as Tumble Jungle and you have never personally ordered goods from PHS, just received them on their behalf in your capacity as employee of Tumble Jungle. Also that the PHS employee tampered with your signature after the event, adding t/as etc..(Take Ame up on her offer to help with the letter, it's important to get it right).

If it were me I would pursue both the owners of Tumble Jungle and PHS for the return of your money and all expenses incurred by their mistakes.

If (big if) a huge PLC (Allenbridge Group) is behind the people who actually owed the money and should have paid the debt rather than land you in this doodoo - it may be a worth a bit of sleuthing...but I also take on what has been said above about the immense stress this has caused you for a long time and only you know whether you want to fight on or draw the line.

I don't know whether you can also still appeal the judgment but others on here will know.

I will take the advise , as I don't want the bailiffs coming again, and I know now that the law I is an ass!
I did post that I would like to do the letter, but not heard back , I didn't want to bother Amethyst , as you all must spend A Great deal of your own time, helping and replying to all that need help.

Re: Can any one tell me what this means?

Hi Pauline the N245 is attached as discussed, if you need any help completing it just ask.

Remember to include EVERYTHING and only offer what you can reasonably afford so there is no possibility of you not being able to make payment.

If there is anything causing you to go into your overdraft, charges etc then look at what can be done to prevent this, i.e cancel direct debits and make alternative payment arrangements etc.

The main priority is to suspend bailiff action and keep your home, then we have more time to look at the issue of the PHS contract.

Once completed take it to court with the fee and should there be any hearing it is very important you attend to explain your circumstances.

                              Good luck
