  • Nuisance Tenant Breaking Tenancy Regulations

    I rent a flat with a Housing Association which is a building with four flats and a communal hallway. One of the tenants is being a nuisance to all of the other tenants. The tenant is opening the communal windows in adverse weather making all of the other flats freezing, there is also the security issue of windows being left open during the night.

    A joint complaint from all of the tenants was sent to the Housing Association, but unfortunately the Housing Association is stating that the tenant is not breaking any tenancy regulations and therefore there is nothing they can do.

    Checking the regulation book it states:
    The Tenancy Agreement Section 2 - Paragraph 4.2 & 4.4
    4.2 Otherwise interfere with the peace and comfort of other occupiers at your Home or visitors or neighbours,
    4.4 Do anything or omit to do anything likely to cause a nuisance or annoyance to any person living in your Home, your neighbours.

    But still the Housing Association are stating that no regulations have been broken.

    It seems very clear to all of the tenants that the regulations have been broken, but does the tenant have any legal right to challenge the Housing Association because the regulations have been broken and it is affecting the other tenants?
