Since summer 2008 I have been having problems with a ground maintenance company or should I say lack of maintenance company. I raised a complaint with them back in July 2008 due to the lack of maintenance to the rear of my property and surrounding site.
Without going into to much detail of the complaint I feel that due to the lack of maintenance and failure to respond to my complaint in a satisfactory manner I have not paid this company since March 2009. They have threatened court action, CCJ, Informing my mortgage provider to name a few tactics. The latest letter was offering a reduction on the outstanding debt if I paid up within 14 days, suffice to say I ignored this letter.
Some of my neighbours are agreeing with me but they have felt obliged to pay due to the threatening tactics described above. I have also involved my local MP as I understand this is not an isolated incident.
1. Can these contracts be written into house deeds. Unfair monopoly
2. If its all above board why haven't they taken me to court in 5 years to claim back the debt?
3. I have never signed an actual agreement with the company and we were not aware on this written into the deeds.
4. If I haven't paid for nearly 5 years will it become SB as the company is registered in Scotland?
I have spent countless hours and correspondence trying to resolve this with the company but haven't got anywhere. When I questioned them in my last phone call they said that they couldn't speak with me as I hadn't paid my bill. This was over a year ago so just ignore them now
