  • CCJ Listing : When?

    Hi Folks,

    I received a judgment today dated 31st Jan but asked to pay by next friday.

    I will like to know when is the deadline that i have to pay to avoid a CCJ on my person.

    Too bad that almost half of the money is interest, court cost etc)

    This sounds like a "forthwith" judgement, on a case the claimant won by default.

    Did you defend the claim at all, or did you not even know about it?

      I knew about it. I defended it citing no default notice bla bla bla. I received the judgment 7 days after hearing date(both parties NOT present) and was asked to pay 7 days after receiving the judgement which is difficult for me.

        Staying off the register
        Nearly all CCJs go on the register:
        • Paying within a month The CCJ will be removed from the register if you pay in full within one month of the day of the judgment.
        Sounds like it was default judgment because you didn't acknowledge/defend/attend and it was probably forthwith, which is why it says you should pay by next Friday. If you can't afford to do this, you can apply for a redetermination. You have 16 days to apply for a redetermination, which, unlike a variation, carries no fee.
        If less than 16 days have passed since the date of the postmark on the letter and you can no longer afford the payment you can apply to the court to look at your offer again. This is known as a ‘redetermination’ and there is no fee.

        Application for redetermination

        Dear Sir /Madam

        I would like to apply for the above judgment to be redetermined under Rule 14.13 of the Civil Procedure Rules. I understand that because the judgment was granted without a hearing I am entitled to have this redetermined at my local county court. As this application also falls within 14 days from the original order I understand that no fee is required.

        I am applying on the grounds that I am unable to pay the amount as ordered on xx/xx/xxxx. I have enclosed an up-to-date budget and list of creditors to help the court reconsider the judgment.

        As you can see my budget shows I cannot pay the amount specified. I am therefore offering to pay £xx.xx per month towards this debt.

        I look forward to hearing from you.

        If you are able to pay in full within a month, then you'll have no CCJ. If you are unable to pay in full, then you can apply for redetermination (the CCJ will stay on record for 6 years).

        Did you not make an attempt to defend this? If you didn't get the court papers, you may be able to apply for set aside in certain circumstances.

            Thank you guys. 1) Do i pay the claimant's directly or their solicitor? 2) Do i need to inform the court once i pay or the onus lies on the claimant to do that? its a pity that i cant appeal the judgement most especially the useless interest
