    hi guys, looking for some help understanding a situation please.

    Advert states "toys for sale, £5 each. Phone Fred on 0123456789" (invitation to treat, bilateral contract - agreed?)

    Phone Fred and he tells me that I can have the lot for £450, which includes discount of 10%, if I buy the 100 available.

    Does this still remain as an ITT, or has this now slipped into being an offer due to the specifics involved?

    thanks for any help to get my old brain to understand this!!!

    Hello Lisa,

    An I.T.T. is a tool to get things under way, i.e. Fred showing what he is willing to accept in the advert.

    When you speak to Fred he 'offers' you specifics as you have stated, and effectively indicates that he is willing to contract with you on the terms specified.

    So, IMO, you are correct that the initial advert is simply an I.T.T., and the telephone call results in Fred making an offer to you to transact.

    I am sure others will be along to agree with me, or to argue that I may be incorrect.
