  • Actions before Taking steps to obtain a CCJ

    Hi,
    My son is trying to recoup the money he spent on a shared house he was renting with the owners son

    About a year ago he moved into a house with a friend the house was the friends Grans but ownership passes to his mother and sister on her death ,the deal was they would both pay rent to the sisters and would spend time and money on refurbishing the house after being promised it was to be a long term rent.

    He spent money on the place and everything was Ok living there with his cats as agreed until Grannie died then it all turned nasty.

    He was asked to get rid of the cats this he was not willing to do so he left after a verbal agreement was reached that he would be reimbursed for the money he spent, after a year of promises from his housemate that he would get the money he has written first to him and then to his parents asking for payment they have received the letters sent recorded but have not answered them ,
    He has asked for a sum of money.

    question

    Does he need to break down the figures and where to next in the letters before he tries for a CCJ if there are any template letters he can use.

    He paid rent to the sister before his friends Gran, who owned the house, died ?

    I suppose there's nothing in writing at all ? any tenancy agreement ?

    If not, it will be based on the verbal contract, first step is to send an LBA with 14 days. This would be against the sister who was presumably acting as an agent for her grandmother (was she in a care home or something?)

    How much money are we talking about? Have the improvements made to the house increased its value ?

      Grannie died that's when it turned nasty nothing in writing all verbal he is to trusting only sees good in people

        What kind of work did he do on the property and how much would the claim be for?

          Redecorating new flooring new internal doors new bathroom fittings general updating hes only trying to get the materials cost back

            summary:
            Flatmates you and your friend pays rent to sister of owner.
            you pay money to refurbish house( did your friend also contribute to refurbishments)
            verbal agreement
            grannie dies
            You were asked to "get rid of the cats"
            How many were there?
            You didn't agree so you decided to leave with your cats and live elsewhere.
            You requested reimbursement for materials used in refurbishment.
            To date letters have been received but no money has been paid.
            Have you spoken to citizens advice bureau?
