We had our roof replaced approximately 5 years ago. Our contractor provided a 15 year warranty for the waterproofing materials. It was one of the reasons why we contracted with them to do the work. We recently found out that the manufacturer and its UK distributor of the waterproofing material have fallen into administration. We had no dealings with either the manufacturer or the distributor. The administrators for the UK distributor told us to write to the manufacturer but no luck. The contractor is still in business. Do we still have protection under the warranty i.e does the roofer have to make good if there are any problems?

What exactly is the problem? Is the workmanship defective, or is it the materials that are at fault?

Exactly who provided the warranty - the contractor, the distributor, or the manufacturer of the materials? Who says that they will 'make good' if there is a problem? Do you have written proof of this?

Do we still have protection under the warranty i.e does the roofer have to make good if there are any problems?

As warranties are in addition to your statutory rights, it might be better to consider an action for the supply of defective goods and/or services. Even if a warranty is useless, the law remains.

There isn't a problem with the work or the materials and we hope there never is. However, an issue has arisen regarding insurance and we want to know what our position is.

The distributor provided the warranty via the roofer. It guarantees the materials not installation. Does the roofer have to stand by the warranty or is it now useless?

That says it all - the roofer is not liable for the warranty.

Is the manufacturer or distributor a member of any trade association? Some have schemes that will pick up the tab if a member goes bust.
