  • new member needing help!!!

    In 2012 we made the decision to close down our business and pursue a new venture, we had a massive sale clearing all our stock ready for our new venture which we advertised this with the local press. Unfortunately beginning of 2013 this fell through with our partners and we had no choice but to reopen our business.We spent over £15,000 re launching this including £7200 we spent on advertising again with the local press as we knew this was something we were going to have to do in order to get our buisness up and running successfully again.
    In August they contacted us about doing another advert to advertise our End of season sale to which we agreed, They sent through an old advertisement template (from when we had done our marketing with them to state that we were closing down permanently) for us to tell them what needed changing via email.We told them that all wording of 'closing down forever' needed to be replaced by 'End of season sale' along with a few prices ect. We never received a proof copy of this new advert so assumed it hadn't made print deadline.
    The next day i had a paper delivered with a full page advert on the back with the main heading stating in bold at the top that we were closing down forever again!They had changed the rest of the advert but not this!!!
    Now since this paper has been issued we have had nothing but problems, phone calls and People coming in wanting to cancel orders as they now think we are permanently closing and not going to get their orders,or People not wanting to put orders in for the same reason! not only is this resulting in a loss of business but people now thinking we are now con artists and doing closing down scams!!

    As i said iv spent over £7000 with them this year re launching my business and now i'm watching it crumble because of them.Iv tried discussing it with them, they have admitted they are in the wrong and offered me two pages free advertising - worth £600 which quite frankly i find insulting!!

    Surely their must be some sort of legal action i can take against them?

          Why not try & turn this to your advantage; get the local paper to do an 'OOps, we cocked up!' feature, telling all how great, thriving, best-thing-since-sliced-bread you are.

            If they have admitted they were in the wrong then they should pay compensation for the issues caused directly by the advertisement being published in that form, which i expect is what you are after. This is far beyond the cost of the advert (and another 'free' advert). You need to work out exactly what financial loss (including your time dealing with the fall out) this has caused and present it to them in response to their offer of ads. If they refuse point blank any liability then you can start with an Letter before Action and bring a claim through the small claims court.

            Do everything in writing.

            Charity's idea isn't a bad one but how much effect that would have I don't know.
