    Hi
    If a solicitor acts without a practicing certificate should the defence they submit be dismissed from use in the court, and should the person be disallowed from entering chambers?

    Practicing Certificates are required so, you must got it...!

      Depends on what capacity the solicitor is acting in?

      And depends on how the solicitor comes to not have a Certificate, for example the SRA often have backlogs on the certs so it is not unenxpected that they delay renewals etc.

      Also is the solicitor an employee of a solicitors practice, if he is then he may sign a statement of truth etc as a representitive of the firm

        HI - thanks but the solicitor is a woman representing her mother against her uncle, has not had a certificate for nearly a year, is using a company name for some correspondence yet that co. has been dissolved, and saying she is the in-house legal manager, yet seems to have no contract? at other times saying she is sole practicioner? seems like a whole lot of misrepresenting to the court. Acting in an unfair dismissal tribunal when registered with the SRA to do financial???

          It would, I guess, be important to find out exactly in which capacity she is representing/helping her mother.

          If it were me, I would start by contacting case management at the ET.

            hi, well its hard to know with these varying titles being used, but seems to be acting as in-house legal representative for mother's company, which she used to work for. Also has vested interests in the business, possibly property/shares, so I am thinking this is a conflict of interest. Most of the witness statements are also from other family members as this is a messy case of a family business going against one of their own for whilstle-blowing. The business is care homes for disabled so some serious stuff here. I've looked at the SRA regs and it appears that this is a potential conflict, should I write to the SRA?
