An advisory letter was at this time written to the Designated Premises Supervisor (DPS), Licence Holder and Club Secretary.In 2011 noise complaints were received about a motor scooter rally (Outdoors) held at the club in June, Environmental Health were not able to attend on the night(s) but the emergency standby Environmental Health Officer at the time called the club to advise of complaints received, and recommended that they do everything in their power to control noise so as not to unreasonably disturb residential neighbours. Following these complaints, the forthcoming motorcycle rally weekend (Outdoors) was then proactively monitored in July. Music was witnessed to be extremely loud during the evening at long distances away from the club. Access to the marquee was prevented by motorcycle club stewards, and upon entering the main bar, the DPS was not on site. The then DPS was called back to the premises and was advised to get control of the music and to reduce the volume of the sound system. This event was also followed up in writing with a warning/advisory letter to the DPS and the Club Secretary.In 2012 complaint was received about the July motorcycle club weekend including traffic/parking/and noise in the street.In May 2013, Environmental Protection received noise complaints from three residents directly, and also from the Parish Council and a County Councillor (who some residents had contacted instead). These noise complaints all related to a beer festival hosted by ****** Sports and Social Club that included a full line up of live bands into the evening, the stage being a lorry trailer outdoors. Given that these complaints were early in the summer, it was agreed with residents that Environmental Protection would proactively monitor the long weekend events namely the motor scooter rally (21-23rd June) and the 4F’s motorcycle club rally (19th-21st July). Prior to these weekend events, contact was made with the Manager for TSSC Mr Alistair McKenzie, and the current DPS Mrs Susan Hicks. I met with them on site, and provided a good deal of advice regarding both Premises License and Statutory Nuisance regimes with respect to noise control. This meeting was followed up in writing (see letter dated 12th June 2013), and I advised that Environmental Protection must investigate the resident’s complaints by way of noise monitoring of the forthcoming weekend events in June and July. The letter set out the potential consequences of noise problems should they be witnessed.Monitoring visits were conducted to check compliance with the current premises licence, and to assess for statutory noise nuisance.NOTE: Although not part of this review application, since monitoring of the weekend long events, Environmental Protection are in receipt of complaints about the ‘ordinary’ indoor entertainments hosted by the club and these complaints necessitate further investigation.Noise monitoring of weekends of 21-23 June, and 19-21 July 2013The Environmental Protection Team conducted noise monitoring on the Friday and Saturday nights of each weekend event. This included monitoring from the gardens, living rooms and bedrooms of 3 different residential properties. Notes from some of these visits are appended.Noise problems were witnessed on the first weekend, and TSSC were notified by telephone and in writing of this (see letter dated 16th July 2013) ahead of the motorcycle weekend event to follow.Both the weekends monitored enjoyed very nice summer weather. On each of the nights monitored it was warm, and you could reasonably expect people to be sitting outside, or indoors with their doors and windows open.The noise monitoring conducted, gathered evidence that for long periods of the evenings, music was intrusive not only in people’s gardens, but inside their living rooms and bedrooms. Music from the TSSC was so audible within people’s properties at times that conversation was difficult and televisions needed to be at high volume to mask the music. Music from the TSSC was completely dominant in residential gardens/patios at times. Within one of the worst affected dwellings, it would not have been possible to try to sleep in the bedrooms until the music had ceased that night.Conclusion and Application for Premises Licence ReviewAlthough complaints directly to the Environmental Protection team are few, evidence has been gathered that Condition 2 of the premises licence under the licensing objective ‘Prevention of Public Nuisance’ has clearly been breached over two weekends this summer.Were outdoor/events in marquees to take place on a more regular basis, then consideration would have been given to statutory nuisance action under the Environmental Protection Act 1990 in addition to calling a review of the premises licence.The only matter that has been raised till recently with Environmental Protection was that of noise from outdoor events at TSSC that take place in the evenings. TSSC allow their club premises and outdoor space to be fully utilised for some events in the summer from Friday through till Sunday when the motor scooters and motor cyclists then leave site. The fact that these events involve noisy vehicles, and have music on Friday night, Saturday afternoon, and Saturday night, mean that the impact of these full weekends in summer is considerable on the local residents, and therefore a review of the premises licence under the licensing objective The Prevention of Public Nuisance is appropriate and necessary in order to seek to modify the licence to reduce the noise impact on the neighbours in future. I am also mindful that planning permission has been granted for demolition of the ***** Mushroom Farm, and the building of new residential dwellings along the boundary of the TSSC thus increasing the number of sensitive receptors around this site.Proposed modifications to the premises licenceSome of the events held at TSSC such as the ****** Carnival are very much for benefit of the local ***** communities. I have no evidence that the carnival (which may include music outdoors) has caused complaint, and therefore my proposals should not affect the running of this event that I understand this year took place between 12:00 and 18:00 hours.I request that the Licensing and Health sub-committee considers the modification of the ****** Sports and Social Club premises licence as follows:1. To add a statement to the premises licence to the effect that the provisions of the Live Music Act 2012 do not apply to this premises licence.(This is in accordance with the Live Music Act 2012 Section 1, sub-section 3, thus allowing controlling conditions to apply to amplified or unamplified live music before 23:00 hours). 2. To modify Condition 3 under ‘Prevention of Public Nuisance’ to read as follows:Regulated entertainment outdoors or within marquees, tents, gazebo’s and other similar structures, shall be restricted so as to occur on no more than 5 days per year, and never on consecutive days.3. To include an additional condition under ‘Prevention of Public Nuisance’ to read as follows:Regulated entertainment outdoors or within marquees, tents, gazebo’s and other similar structures, shall take place between the hours of 12:00 and 18:00 only.4. To remove Condition 4 under ‘Prevention of Public Nuisance’ as it is unclear where this originated, what it seeks to address, and whether or not it is enforceable.
