    Hi There People
    I am at the start of a County Court action and I have submitted my "Allocation Questionnaire "I have been asked to provide a "Case Summary" and "Draft Directions" before my "Case Management meeting".
    I would love to employ the services of a Solicitor but I only get a Government Pension and have no savings, these were all wiped out by the two defendants. I have also been served with an “Application Notice to Strike out” by their Solicitor who I think is trying unsuccessfully to scare me.

    I have three questions;
    1. Reference to "Application Notice to Strike out" do I answer them in the order they are raised ?
    2.Reference “case summary” is there a limit to the length ? Also due to the nature of the case, the timeline will not run consecutively, does that matter ?
    3.Reference “Draft Directions” I have searched the internet and I cannot find anything that helps me.

    I have asked numerous Solicitors firms if they will be willing to take on the case on a “no win no fee” basis and they all want a substantial amount of money up front.
    To offset that I have said that I will pay 30% of monies recovered and if somebody contacts me I will do the same ! ! ! !
    My claim runs into SIX FIGURES
    The thing is the majority of the work has been done it just needs somebody with the legal terminology to put the point across.
    ANY help will be much appreciated.

    As this claim runs into 6 figures, it will be allocated in the 'multi track'. Therefore if you lose you will owe tens of thousands in costs.

    Have you properly considered the risks?

    OK, so the allocation questionnaire assists the court in how the case should be managed. Length of time for a multi track is usually 3 days in front of a senior Judge.

    So the opponent has made a reference to striking out your claim because...? "insufficient particulars of claim" perhaps?

    Be certain that you Particulars of Claim are VERY well drafted as you will be relying on them very heavily. If you miss anything, you would need the courts permission to amend the POC.

    So unless you feel that your POC is weak and you seek permission to amend it, I'd not worry too much about their suggestions of strike out.

    Case Summary is just as it sounds. Try to keep it brief and logical. It is only used to assist in 'tracking' the claim at this stage. Your Skeleton argument will set the case out in more detail ahead of the final hearing.

    Draft Directions are 'what you are seeking the court to order' exactly? i.e repayment of monies owed, damages, or something like an order for specific performance of an act such as removal of adverse data from a credit agency etc.

    But aside from all of that, I am VERY concerned that you are taking on a multi track case with no solicitor, with seemingly very little comprehension of the most basic court terms and procedures. It is only going to get a lot harder and more complex. How will you prepare a skeleton? How will you deal with the advocacy? Are you referencing all the correct legislation and case law that you should?

    Please tell us more about the claim if you can :beagle:

      In light of the very good informative previous post,I have just found a document called "Skeleton Arguments: A Practioners Guide" written by Michael Kallipetis QC & Geraldine Andrews QC.

        The big question is, if the authorities had 75 complaints, how did they get
        them to plead guilty to just 8 charges???

        Surely all the complainants have the right to justice!!!!
