Re: Judicial Review - help please

I would have thought that realistically ATE wouldn't be available or afordable to litigants in person as the chances of failure would necessarily be that much greater.

There are some brokers out there who can source it for the wild and wacky claims, The Judge is one broker who have managed to get some claims insured that others wouldnt touch.

While i agree with you it will be tricky, theres no harm in asking , the worst they can say is no really

Thanks - to clarify - ATE - stands for After the Event Insurance?

How is this meant - literally ie the Judge(s) or a firm of that name?:

Are the any ATE-brokers other than the Judge that might be able to offer an ATE for litigants in person?

Re: Judicial Review - help please

There are few firms offering this specialised cover, but I've not heard of it being made available to private individuals. It was always regarded as commercial business.
It is also prohibitively expensive, and even if you win you can no longer (since April ?) recover the premium cost from the other party.

Some insurance policies, such as home or car insurance, or even AA membership, etc, often has legal services cover attached.
                      It's worth a look!
                      They wold sort out ATE.

I doubt it. Legal expenses tacked onto motor insurance is there to assist in recovering uninsured motoring losses. ATE cover is very specialised and IMO home insurers wouldn't countenance it.

Another outfit that might help can be found at universallegal.co.uk. I have never dealt with them but an old (or should that be "ex") colleague of mine has suggested them as a possible. A phone call initially (01234 340266) might save a lot of wasted form filling, as I'm pessimistic about ATE being available to a litigant in Person.

I was offered legal assistance for an employment dispute via my home insurance.
They advised that they would arrange ATE.
However, things may have changed with the new rules concerning non-recoverable costs, ATE being one of these.

Lucky you.......was it a cast iron case (if there can be such a thing with our court system)?

Or was it BTE cover that said you can go ahead with the action about the event which has occurred?

As you rightly suggest, a court (or Tribunal) case can go either way; we're in the laps of the gods!

I guess they merit-tested it & decided the case stood at least an even chance of success.

                                Yup...see my edited post Charity.

"After the event" coverage is effected after the occurrence.
If you have Legal Expenses coverage on your household policy, this has been effected "before the event" and it will depend on how your insurers view the soundness of your case as to whether or not they will agree to fund it. That is BTE not ATE, which is what OP was asking about.
