Can anyone advise me on how to withdraw a small claim in the English County Court system?
The reason is that MCOL now accepts claims from Scotland, so my claim was raised from Scotland against MBNA online using MCOL.
I was not advised that the claim COULD NOT be transferred to Scotland, if it reached the Allocation stage.
My claim is now Allocated to the Carlilse County Court - 450 miles away as it is the "closest county court" to my address.
I wish to withdraw my claim, but not lose the right to submit it again, as I intend to raise it in my local Sheriff Court.
I already wrote to the court asking if it was possible, their District Judge's response was......
"This court cannot make comment as to the legal effect of discontinuance upon the possibility of proceeding inn Scotland, as that is a matter of Scottish Law"
